Notice of Public Hearing

Public Hearings are held to give the public an opportunity to give public input on a matter before the County Board.

Along with publishing notice on our web site, the notice of a public hearing is required to publish the time, place, and purpose of any public hearing in a newspaper of general circulation in the area concerned, and in the official newspaper of the county, at least ten days before the hearing.

In some cases, public hearing notices are also required to be sent to property owners of record within a certain range of an affected property. 

Notice of Public Hearing

Pursuant to Minnesota Statute, Chapter 375, notice is hereby given that the Stearns County Board of Commissioners shall conduct a public hearing on Tuesday, May 22, 2012 at 10:05 a.m. in the County Board Room, Stearns County Administration Center, 705 Courthouse Square, St Cloud, Minnesota to consider an application to hold a Large gathering (the “Mud Man Races”) at Powder Ridge in Maine Prairie Township. 

All interested persons are invited to attend said hearing or submit written testimony prior to the hearing date.  Written testimony should be submitted to Hank Schreifels at Stearns County Environmental Services Department, Stearns County Administration Center, Room 343, 705 Courthouse Square, St Cloud, Minnesota 56303.

Notice of Public Hearing

Notice is hereby given that the Stearns County Board of Commissioners, in and for the County of Stearns, will conduct a public hearing to consider a rezoning request submitted by Monitor Tire Disposal Inc., St. Martin MN and Liberty Tire Services of OH LLC, Savage MN to rezone approximately 5 acres from the Agricultural 40 (A-40) zoning district to the Industrial zoning district in accordance with Section 4.10 of Stearns County Land Use and Zoning Ordinance #439.  The property under consideration is part of SW1/4 SE1/4, lying northerly of Sauk Valley Road in Section 33, St. Martin Township (124/32). 

Notice is further given that the above hearing will be held on Tuesday, May 22, 2012 beginning at 10:15 a.m. in the County Board Room of the Stearns County Administration Center, located at 705 Courthouse Square, St. Cloud, MN  56303.

All interested persons are invited to attend said public hearing or submit written testimony prior to the hearing date.  Written testimony should be submitted to Angie Berg at the Stearns County Environmental Services Department, Administration Center, Room 343, 705 Courthouse Square, St. Cloud MN  56303.

Notice of Public Hearing

Notice is hereby given, pursuant to Minnesota Statute, Section 394.26, that the Stearns County Board of Adjustment, in and for the County of Stearns, will conduct a public hearing on Thursday, May 24, 2012 in Conference Room 121 CDE, Stearns County Service Center West, 3301 County Road 138, Waite Park, MN, beginning at 6:30 pm.

Purpose of the hearing is to consider the granting or denial of variances from the Stearns County Zoning Ordinance, Stearns County Subdivision Ordinance, Stearns County Sewage Treatment Ordinance, Stearns County Recreational Campground Ordinance, Stearns County Lodging Establishments Ordinance, Stearns County Childrens Camps Ordinance, and the Stearns County Manufactured Home Parks Ordinance as follows:

Public Hearings:

1. To consider a request from Rock On Properties LLC, Waite Park, MN, from Section 6.5.1E of the Stearns county Subsurface Sewage Treatment System Ordinance #422 to install a holding tank for a subsurface sewage treatment system for a commercial building. Said Ordinance does not exempt a commercial building from the requirement of installing a sewage system with a drainfield. Affected property:  Lot 1, Block 1, Bergstrom Industrial Park, Section 19, T124N, R28W, City of Waite Park.  Property address:  3100 7th St S, Waite Park, MN.

2. To consider a request from George Carleton, St. Joseph, MN, from Section 9.9.9A(3) of the Stearns County Zoning Ordinance #439 and Section 6.5 of the Stearns County Subsurface Sewage Treatment System Ordinance #422 to construct an accessory building and a residential dwelling 40 feet and 27 feet, respectively, from the centerline of Olive Road, which is a platted road, and to serve the residential dwelling with only a holding tank septic system. Said related Ordinances require a structural setback of 63 feet from the centerline of a platted road and do not allow for a holding tank septic system for new residential structures, respectively.  Affected property:  Lot 3 of Maple Grove Addition, Section 26, T125N, R29W, St. Wendel Township.  Property address:  861 Olive Rd, St. Joseph, MN.

3. To consider a request from Gregg & Jennifer Larson, Sartell, MN from Section 10.2.11D(2) of the Stearns County Zoning Ordinance #439 to leave as installed a fence ranging in height from 4 feet 2 inches to 4 feet 6 inches located ahead of the building line on a parcel on the Mississippi River.  Said Ordinance requires that fences erected from the building line to the ordinary high water level shall not exceed a height of 4 feet.  Affected property:  1.00A P/O Govt1, Section 9, T125N, R28W, LeSauk Township.  Property address:  2284 Rodeo Road, Sartell, MN.

4. To consider a request from the City of Paynesville, MN from Section 9.8.9A(3) of the Stearns County Zoning Ordinance #439, to construct a government service building 33.42 feet from the Right-of-Way of SH23 which is classified a Major Arterial Road.  Said Ordinance requires new structures to be located at least 75 feet from the Right-of-Way of a Major Arterial Road.  Affected property: 1.52A SE Corner of NE4, Section 9, T122N, R32W, Paynesville Township.  Property address:  Junction of old 185th St & CR 133, Paynesville, MN.

5. To consider a request from Dennis & Janyce Schmitz, Kimball, MN, from Section 10.2.11A(1)(a) of the Stearns County Zoning Ordinance #439 to construct an addition on to a residential structure located 87 feet from the Ordinary High Water Level of Carnelian Lake which is classified as a Recreational Development Lake.  Said Ordinance requires a setback of 100 feet from a Recreational Development Lake.  Affected property:  .65A of Govt Lot 1, Section 13, T122N, R29W, Maine Prairie Township.  Property address:  17046 Danzig Road, Kimball, MN.

6. To consider a request from Margaret Smith Wenner, Richmond, MN from Sections 9.9.9A(3) & 10.2.11A(1)(a) to replace existing illegal nonconforming decks located, at the closest point, 50 feet from the Ordinary High Water Level of Cedar Island Lake, classified a Recreational Development Lake and 67 feet from the centerline of SH 22, classified a Minor Collector Road.  Said Ordinance requires a structural setback of 100 feet a Recreational Development Lake and 100 feet from the centerline of a Minor Collector Road.  Affected property:  1.16A of SE4NW4, Section 25, T123N, R31W, Munson Township.  Property address:  21692 State Highway 22, Richmond, MN.

7. To consider a request from Mike Moscho, Freeport, MN, from section 6.7.5D of the Stearns County Zoning Ordinance #439 to construct a 50 ft by 240 ft total confinement feedlot structure 72 feet from the property line. Said ordinance requires a property line setback of 100 feet. Affected property: 22.00 A. S 1000' OF W 958' OF SW4SW4 of Section 9, T124N, R32W, St. Martin Township. Property address: 30082 293rd Ave, Freeport, MN.

8. To consider a request from Gerald and Lisa Haus, Cold Spring, MN, from Section 6.7.5 of the Stearns County Zoning Ordinance #439 to construct a new residence 457 feet from an existing feedlot. Said ordinance requires a 700 foot setback from a feedlot to a new residence.  Affected property:  40.00 A. NW4SW4 Section 2, T123N, R30W of Wakefield Township. Property address: 153rd Ave. Cold Spring, MN.

All applications and related information are on file with the Environmental Services Department, Room 343, County Administration Center, 705 Courthouse Square, St. Cloud, MN.

All interested persons are invited to attend said hearing or submit written testimony prior to the hearing date, either in support of or in opposition to the requests.  Written testimony should be sent to the Stearns County Board of Adjustment, Stearns County Environmental Services Department, Administration Center Room 343, 705 Courthouse Square, St. Cloud, MN 56303.
